Over Parkland

Controversy is brewing before
the North Andover Zoning Board of Appeals over property
located at 50-53 May Street.
The property is presently owned by the North Andover
Housing Authority. An application was recently submitted
by the Authority to the Town of North Andover for a
special permit under Chapter 40B to “erect a
two-family dwelling upon vacant
premises.”
The prior owner of the property is opposed to the Housing
Authorities request to build a two family house and
argues that the property is not a “vacant
premises.” Prior owner of 50-53 May Street,
Violet Kondrat, states that the property is a park and
should remain a park.
Back in 1981 then owner, Violet Kondrat, sold her land on
May Street to the North Andover Housing Authority with
the expectation that it would become a park. The
attached letter dated September 13, 1981 written to
Violet by then executive Director of the North Andover
Housing Authority, Louis Minicucci, states “This
property will be utilized for the construction of a
park.”
During this negotiation process between Violet and the
Housing Authority, the Town of North Andover
applied for and received a Community Development Block
Grant in the amount of $80,000 to “develop new park
at May Street, adjacent to McCabe Court.” as
indicated in the Authority’s Annual Report for the
fiscal year ending September 30, 1982.
And in the Housing Authorities Annual Report for Fiscal
Year ending September 30, 1983, under the heading
Modernization Activity Completed, it states
“completed park on May Street, adjacent to McCabe
Court.”
Prior owner, Violet Kondrat, has filed a written
objection with the North Andover Board of Appeals, asking
that the land remain a park.
The matter is scheduled to be heard at the September 11th
Board of Appeals
meeting.
