Solomon's attorney, Andrew Gambaccini
told The Valley Patriot this afternoon
that the ruling was “no
surprise” and that “anyone
could have told you that he would be
fired last October.”
Gambaccini said that there was never any
doubt that Solomon was going to be fired
no matter what the evidence showed at the
hearing, “When the appointing
authority puts you on leave and says
publicly he is not going to bring you
back, that is a removal.”
Gambaccini said that Solomon will appeal
to civil service and will argue that the
removal took place wrongfully last year.
Gambaccini also said that he could not
compel Mayor Manzi to testify at the
hearing but that Manzi will
“I was not able to subpoena
witnesses in the hearing and we requested
that mayor Manzi testify but he put
conditions on his appearance. He said he
would testify, but only if he could
testify last and as long as there were no
rebuttal witnesses called after his
testimony. He also wanted advanced notice
of what topics were going to be
discussed. We didn’t agree to those
conditions so he never testified,”
Gambaccini said.
He did say that when the matter goes
before the Civil Service Commission, he
will be able to call the mayor to testify
and he will be compelled to appear.
"He can duck testimony here but he
can be compelled at the next level and he
will be doing that," he said.
A status conference s scheduled for next
month in civil service.
